BY ACCEPTING THESE TERMS OF USE DURING REGISTRATION PROCESS YOU CONFIRM THAT YOU HAVE READ AND AGREE TO BE BOUND BY THESE TERMS OF USE, WHICH INCLUDE VERSUS’ PRIVACY POLICY AND OTHER GAME, SOCIAL, WAGER OR OTHER TERMS RELEVANT TO YOUR PARTICIPATION.
Welcome to Versus! These Terms and Conditions ("Terms") govern your access to and use of the Services provided by Versus Gaming LLC, doing business as Versus ("Versus," "we," or "us"). The Services include our social marketplace where users can access sports data, sports analytics, chat with friends, and make peer-to-peer bets with other users. Each unique sport or contest may have specific rules that you should consult to understand the parameters and terms for those games. By using our Services, you agree to comply with these Terms and any additional terms and rules applicable to the specific Services you choose to use. It is important that you read and understand this information, as it outlines how our Services operate and defines your rights and expectations. By accessing and using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, including any updates or modifications that may be made from time to time. If you do not agree to these Terms, you should not use our Services.
2.1. Registration
In order to access and use certain features of our Services, you may be required to create an account. You must provide accurate and complete information during the registration process and keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised or accessed without authorization, please notify us immediately.
2.2. Age Restriction
You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you are of legal age to enter into a binding contract.
3.1. License
Subject to your compliance with these Terms, Versus grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for your personal, non-commercial purposes. This license does not permit you to resell or make any commercial use of our Services or their contents.

4.1. Virtual Currency
Versus may offer virtual currency or credits, referred to as "Versus Coins," which can be used within our Services. Versus Coins have no cash value and can only be used for in-app purchases or activities as determined by Versus. Versus Coins cannot be exchanged for real currency or transferred to other users.
4.2. Purchases
You may purchase Versus Coins through authorized methods made available by Versus. All purchases are final, and Versus does not provide refunds or exchanges for Versus Coins.
You understand and acknowledge that any information, data, or content you provide through our Services is your sole responsibility. You represent and warrant that you have the necessary rights to provide such information and that it does not violate any third-party rights or applicable laws. Versus reserves the right to remove or modify any information or content that violates these Terms.
Versus may offer promotions, contests, or other activities ("Promotional Activities") that are subject to additional terms and conditions. Participation in Promotional Activities is voluntary, and by engaging in such activities, you agree to comply with the applicable terms and conditions.
7.1. User Responsibilities
You are solely responsible for your interactions with other users of our Services. Versus does not endorse, verify, or guarantee the accuracy, authenticity, or reliability of user-generated content or communications. You are encouraged to use caution and exercise common sense when interacting with other users.
7.2. Disputes
Versus is not responsible for any disputes, claims, or damages that may arise between you and other users. You release Versus from any and all liability related to such disputes.
By using our Services, you consent to receive electronic communications from Versus, including but not limited to emails, notifications, and messages. These communications may include service announcements, administrative messages, and promotional materials. You can opt out of receiving promotional emails by following the instructions provided in the email.
You agree to indemnify, defend, and hold harmless Versus, its affiliates, and their respective directors, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of our Services, violation of these Terms, or infringement of any intellectual property or other rights.
Our Services may contain links to third-party websites or advertisements. Versus is not responsible for the content, privacy policies, or practices of these third parties. You access and use such third-party links or ads at your own risk.
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. VERSUS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
IN NO EVENT SHALL VERSUS, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
These Terms will remain in full force and effect while you use our Services. Versus reserves the right to suspend or terminate your access to the Services at any time for any reason without notice or liability.
Versus respects the intellectual property rights of others. If you believe that any content on our Services infringes your copyright, please notify us in accordance with our Copyright Policy.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose your personal information.
These Terms constitute the entire agreement between you and Versus regarding your use of our Services and supersede any prior agreements. If any provision of these Terms is deemed invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms shall be governed by and construed in accordance with the laws of Jefferson County, Colorado, without regard to its conflict of laws principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Jefferson County, Colorado.
